Terms of Use

1. Accepting these terms

These Terms of Use (“Terms”) are a binding agreement between you and Buhrn Technologies LLC, a Texas limited liability company headquartered in Houston, Texas, which owns and operates the Street Eats software product (“Street Eats,” “we,” or “us”). By accessing or using Street Eats, creating an account, downloading the app, or viewing eatonthestreets.com, you agree to these Terms and our Privacy Policy. You must be at least 13 and legally able to enter this agreement. If you are between 13 and the age of majority where you live, a parent or guardian must agree to these Terms on your behalf where required. If you use Street Eats for a business, you confirm that you can bind that business.

2. What Street Eats is (and is not)

Street Eats is a discovery and visibility platform. The live map shows status, location, and menu information that participating businesses choose to publish. When Ping a Truck and Hot Spots are available, Street Eats may also show privacy-conscious demand signals. We do not own, operate, employ, manage, endorse, inspect, or control any food truck, mobile vendor, venue, or event; we do not prepare or sell food. Live-map discovery does not create a booking. When Bookings is available, Street Eats hosts the request, quote, messages, and payment between a user and a participating Food host; the Food host remains the seller of the event service, and Street Eats keeps a stated platform fee from the money processed through the app (Section 9A). Features may be labeled beta, preview, coming soon, or pre-launch; those features are provided for evaluation and may change or stop without notice.

3. Accounts and acceptable use

Keep account credentials secure and provide accurate information. One person or business may not create accounts to evade limits, hide a competing project, or test Street Eats for a product you intend to copy. Do not impersonate others, submit fraudulent pings or listings, upload unlawful content, submit another person’s personal information without authority, or use Street Eats to harm people or property. Sections 4 and 5 state additional hard limits on what you may take from Street Eats. We may restrict, suspend, or close accounts that violate these Terms or create risk for other users, vendors, or Street Eats.

4. Ownership and limited license

Street Eats is owned by Buhrn Technologies LLC. That ownership covers the software, apps, website, interfaces, maps, layouts, icons, copy, audiovisual presentation, and trademarks, including Street Eats, Ping a Truck, Hot Spots, and Hotspot Pot. It also covers our compilation, arrangement, and presentation of vendor listings, live locations, hours, menus, images, demand signals, pings, Hot Spots, and related data as they appear in Street Eats. The method of showing live mobile-vendor visibility in this product is our work. All rights not expressly granted are reserved.

We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use Street Eats only to find participating vendors or, if you are a participating vendor or partner, to publish and manage your own listing. This is a permission to use the product. It is not a sale, assignment, or data license. You do not receive ownership of Street Eats, any Street Eats dataset, any compiled map or listing, or any right to reuse that information outside the app. Content a vendor submits about its own business remains subject to Section 10. The compilation of that content inside Street Eats belongs to us.

5. No scraping, harvesting, or replication

Street Eats is licensed for ordinary use of the live map and related features. It is not a public data feed, a research corpus, or a kit for building another product. You may not, directly or through any person, employee, contractor, bot, script, browser extension, model, or other service:

• Scrape or harvest: crawl, spider, mine, index, cache, mirror, frame, bulk-download, or systematically collect any Street Eats listing, live location, menu, image, ping, Hot Spot, demand count, user activity, or other content or data.
• Copy the product: use Street Eats, or any data, screenshot, recording, or observation obtained from it, to build, operate, improve, or assist a competing or substitute food-truck discovery app, live map, demand-signal product, ping or Hot Spot feature, vendor directory, or visibility platform.
• Copy the look and flow: imitate Street Eats screens, workflows, trade dress, feature sequence, or distinctive presentation of live vendor visibility.
• Train models: use Street Eats as a source, feed, or training set for any dataset, software, or machine-learning or artificial-intelligence model.
• Extract the system: reverse engineer, decompile, or extract source code, APIs, or non-public interfaces except where applicable law expressly allows and only to the limited extent that law cannot be waived.
• Bypass protections: disable, interfere with, or go around rate limits, access controls, robots rules, authentication, encryption, or other technical protection, or create accounts or automated sessions to evade these rules.
• Resell our data: sublicense, commercially redistribute, or publish Street Eats data as a feed, list, or competing directory.

Independent work that never uses Street Eats access, data, screens, or confidential information is outside this restriction. Using Street Eats to shortcut that work is not. Creating an account, watching the map, or calling the use “research” does not grant a license to take or reuse our data.

Any act listed in this section is a material breach. You acknowledge that the compiled live-vendor map, listings, and demand signals have independent commercial value; that unauthorized taking or reuse causes irreparable harm; and that money damages may be inadequate. On breach we may immediately suspend or terminate access without notice; demand deletion and written certification that copies, models, and derived datasets were destroyed; seek injunctive and other equitable relief without the informal-resolution wait in Section 16 and without posting a bond to the extent the law allows; recover actual damages, disgorgement of profits, statutory damages where available, and reasonable attorneys’ fees and costs; and refer the matter for civil or criminal investigation under applicable computer-fraud, copyright, trademark, and trade-secret law. We may use technical measures to detect and block scraping and competing use. Circumventing those measures is an independent breach. A licensed data, API, or partnership arrangement exists only if we sign it in writing first.

6. Maps, live data, Ping-a-Truck, and Hotspot Pot

Truck locations, hours, menus, arrival estimates, map results, and, when available, Hot Spots and Hotspot Pot pools are supplied by participating businesses and users, can change without notice, and may be delayed or inaccurate. When Ping a Truck is available, a ping expresses interest; it is not an order, reservation, payment, guarantee of service, or promise that any vendor will see, accept, or respond to it. When Hotspot Pot is available, it lets a group pool an optional tip tied to a demand signal. It does not create a booking, reserve a truck, guarantee a fill level, guarantee arrival, or obligate any vendor to respond. Tips and related service fees are collected only under the conditions shown in the app. No feature of Street Eats guarantees that a truck will appear at any place or time. During early launch periods, fewer active users and vendors can mean slower responses and quieter demand signals until local participation grows. That is expected for a two-sided discovery network. Use ordinary care when traveling, parking, meeting, or purchasing from a vendor.

7. Mobile vendors and local law

Street Eats may include food trucks, carts, trailers, mobile coffee and beverage businesses, and other vendors on wheels where legally permitted. Vendors are solely responsible for their own licenses, permits, health inspections, food and beverage safety, allergen disclosure, taxes, insurance, staff, pricing, menu accuracy, lawful parking and operation, and every transaction with customers. Using Street Eats does not make a vendor compliant with any law, and Street Eats is not responsible if a vendor, customer, or partner fails to follow federal, state, or local requirements. We may remove or decline listings at our discretion.

8. Partners and event coordinators

Event listings, partnership discussions, estimated attendance, vendor interest, and, when available, Hot Spots do not create a booking and do not guarantee turnout, sales, vendor availability, permits, site access, utilities, or service capacity. Coordinators and vendors are responsible for their own written agreements, insurance, permits, safety plans, fees, and event operations. Street Eats is not an agent, broker, or promoter for any party.

9. Subscriptions, payments, and promotional offers

Customer discovery is free. Some owner features require a paid, auto-renewing Street Eats Official membership on the App Store or Google Play. Native purchases are billed by Apple or Google and managed through the applicable store and RevenueCat; eligible business arrangements may be processed by Stripe. Price, renewal period, trial, tax, and cancellation details shown at purchase are part of these Terms. Store purchases can be managed or cancelled through the applicable store account. Deleting a Street Eats account does not cancel store billing by itself.

Street Eats may offer eligible new food-truck and mobile-vendor accounts one promotional month without a membership charge. Unless the activation screen states otherwise, the offer is limited to one redemption per eligible business or account, is nontransferable, and has no cash value. Included features, eligibility, offer dates, and any renewal price will be shown before activation. Promotional access does not guarantee visibility, customer response, sales, bookings, or other business results. We may modify or end a promotion for future redemptions at any time.

9A. Bookings: private events and catering

What Bookings is. Bookings lets a user book a participating Food host for a private event through Street Eats: a request, a quote from the Food host, a deposit, a balance, and one conversation that holds the record. Bookings is coming in Street Eats 2.0.0. You cannot book in the public app yet. A booking is a real-world service, not a restaurant order and not a digital good.

Who you are dealing with. The Food host is the seller and merchant of record for every booking. Street Eats is a marketplace. We host the request, the quote, the messages, and the payment, and we act as the Food host’s limited agent to collect payment from the user. We are not the caterer. We do not cook, staff, deliver, or perform the event, and we do not guarantee that a Food host will respond, quote, or show up.

Request, quote, accept. A user sends a request with the event date, time window, headcount, address or map pin, and the amount they are asking to pay. That request is an offer. It does not reserve a date. The Food host may decline, quote the user’s number, or quote a different number, as one total or as itemized lines that add up to the total. A quote stays open for 24 hours. Notes in the thread are discussion, not the price. The date is reserved when the user accepts an open quote and pays the deposit. If the deposit is not paid within 24 hours of accepting, the hold releases and the date opens back up.

What the user pays. The accepted quote is the price of the Food host’s service. It is collected in two legs: a deposit at accept, and the remaining balance on the event day. If the quote shows no separate deposit, the full amount is due at accept. On each charge the user pays that leg of the quote plus:

• Card processing: the card-processing cost for that charge, itemized separately so the Food host’s price is not reduced by it.
• Sales tax: where the Food host is registered to collect it, tax is calculated by Stripe at checkout and added on top. The Food host is responsible for its own tax filings.

Every amount is shown on the quote and again at checkout before the user pays.

Street Eats’ fee. Street Eats charges the Food host a platform fee of 4.99% of the accepted quote, with a $10 minimum and no maximum, unless a written partner arrangement sets a different rate. The fee is collected as an application fee on the deposit charge, so it comes out of the Food host’s share of the quote. It is not an extra line for the user. The Food host sees what it keeps before it sends a quote. Card processing is passed through and is not part of the 4.99%.

How payment moves. Payment runs through Stripe. The charge is made on the Food host’s Stripe connected account with Street Eats’ fee taken as an application fee, so user money for food goes to the Food host, not onto Street Eats’ books. Bookings are paid through Stripe Checkout in your phone’s browser, not through Apple or Google in-app purchase, because a booking is a physical, real-world service (App Store Review Guidelines 3.1.3(e) and 3.1.5, and the Google Play payments policy exemption for physical goods and services). Street Eats sends a confirmation after the deposit is paid.

Cancellation by the user. Each Food host chooses one of three cancellation presets for its bookings. The Food host’s preset is shown on the quote before the user pays, and it is part of the booking. The refund depends on how many days remain before the event when the user cancels:

• Flexible: full refund 7 or more days before the event; half refund 2 to 6 days before; no refund after that.
• Standard: full refund 14 or more days before the event; half refund 7 to 13 days before; no refund after that.
• Strict: full refund 30 or more days before the event; half refund 14 to 29 days before; no refund after that.

The percentage applies to what the user has actually paid toward the quote. Stripe refunds the matching share of the card charge (food, plus the matching share of card processing and tax). Street Eats keeps the 4.99% booking fee that was taken from the Food host when the deposit was paid. That fee is earned when the booking is arranged. If the Food host cancels, or a no-show is confirmed because the Food host did not stamp that they arrived, the user receives a full refund of everything paid, including that fee. The app shows the exact refund before you confirm a cancellation. Amounts not yet charged are simply not collected. The remaining balance is charged on the event day from the card saved at deposit; if that charge needs a check, Stripe Checkout opens the same way the deposit did.

Cancellation by the Food host. If the Food host cancels a booking, the user receives a full refund of everything paid, including card processing and the Street Eats fee, no matter how close to the event. The cancellation is recorded and counts against the Food host’s public trust line in Street Eats. If a user reports a no-show after the event has started, and the Food host has not stamped that they arrived, Street Eats refunds the user in full, including the fee, and counts it as a Food host cancellation. If the Food host did stamp arrival, the report is reviewed. Repeated Food host cancellations can lead to Bookings being turned off for that Food host.

Keep the money on Street Eats. A booking arranged through Street Eats must be paid through Street Eats. Asking for or making payment off the app for a booking that started here (cash, Venmo, Zelle, a card reader at the event, or anything else) is a breach of these Terms for whoever asks, and removes the refund and dispute protections described in this section. Either side can report an off-app payment request from the thread. We may remove a Food host or a user for it. A voluntary tip to the crew at the event is not a booking payment.

Messages. Booking messages stay in the Street Eats thread so both sides have a record. Messages are labeled as user or Food host with the person’s name. Food host crew may reply once a date is reserved. We may review messages when reasonably needed for safety, fraud, a dispute, or the law.

Ratings. After a completed booking, or one the Food host cancelled, each side may leave one thumbs up or down, an optional tag, and a short note. Ratings are double-blind: neither side sees the other’s rating until both have rated or 14 days have passed, whichever comes first. A Food host’s public trust line appears after it has three or more ratings. We may remove or hide a rating that is unlawful, harassing, off-topic, includes personal information, was left in exchange for a refund or payment, or relates to a booking that was never paid. We do not edit ratings and we do not remove one because a party disagrees with it.

Problems and disputes. If something goes wrong, the fastest path is Report a problem inside the booking thread in the app. Refund requests must be opened within 7 days after the event date. If you cannot open the app, use the website contact form with the topic Booking dispute or refund and include the booking ID from the thread. Street Eats reviews the thread, the quote history, and the payment records. We may pause a Food host’s payouts while we look, and we may issue a full or partial refund, or none, based on what happened and the Food host’s cancellation preset. Our decision resolves the matter on Street Eats; it does not limit your legal rights. If you dispute a charge with your card issuer instead, that chargeback is handled through Stripe under Stripe’s rules, the booking is frozen while it is open, and we will share the thread and payment records as evidence. Opening a report never counts against the person who opened it.

User identity verification. Before you can send a booking request, message a Food host in a booking thread, or pay a deposit or balance, you must complete identity verification for that Street Eats account. Verification is hosted by Stripe Identity: a government-issued photo ID and a matching selfie. Street Eats does not collect those documents in the app. Stripe decides whether the check passes. A successful verification is locked to your signed-in account and is not transferable to another person or another Street Eats account. Verify the account you will use for bookings. Until Stripe reports the check as verified, you cannot send a request. If verification fails or you cancel, you can try again from Help, under Verifications, or from the booking screen. Street Eats may pause Bookings for an account if Stripe later revokes or restricts the verification. See the Stripe Identity Terms and the Privacy Policy.

User responsibilities. Complete identity verification for the account you use to book. Give an accurate event address or pin, an accurate headcount, and honest details about the event. Make sure the Food host can actually get in: site access, a legal place to park a vehicle of that size, and any permission or permit the property or your city requires for a food truck at a private event. Pay the accepted quote on time. Treat crew with respect.

Food host responsibilities. Before turning on Bookings, a Food host must complete Stripe Connect onboarding, including United States identity and bank verification, and accept the Stripe Connected Account Agreement. Payouts to the Food host are made by Stripe on Stripe’s schedule, not by Street Eats. Stripe issues any required Form 1099-K to the Food host; Street Eats does not. If Stripe restricts a Food host’s account, the Food host stops accepting new bookings until it is cleared. The Food host is solely responsible for its food, staff, licenses, health permits, insurance, equipment, allergen disclosure, sales tax, and for performing the event as quoted. Street Eats does not inspect, certify, or insure any Food host.

Our fee and this section can change. We will show the fee that applies before you pay, and a change to this section applies to bookings accepted after the new effective date, not to ones already reserved.

10. Your content and feedback

You keep ownership of content you submit. You give Street Eats a worldwide, non-exclusive, royalty-free license to host, format, display, and use it as needed to operate and promote the service. You confirm that you have the rights to submit that content and that it is accurate and lawful. We may remove content that is unlawful, unsafe, misleading, or infringes another person’s rights. If you send ideas, suggestions, or feedback about Street Eats, you grant us a perpetual, irrevocable, royalty-free right to use that feedback without obligation or attribution, and you waive any claim that our use of similar ideas creates ownership or compensation rights for you. Feedback does not give you any ownership in Street Eats.

11. Third-party services

Street Eats links to and relies on third-party services, including social platforms, map providers, app stores, and payment processors. Those services operate under their own terms and privacy policies, and we are not responsible for their content, availability, or conduct.

12. Contact and support channels

The website contact form, email address, and official social accounts are channels for inquiries only. Sending a message does not create a contract, service-level commitment, partnership, employment relationship, data license, or attorney-client privilege. We may decline, deprioritize, or stop responding to abusive, unlawful, spam, or out-of-scope messages.

13. Disclaimers

Street Eats may add, change, suspend, or discontinue features at any time. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREET EATS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF UNINTERRUPTED AVAILABILITY, ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that any vendor will be where the map shows it, respond to demand, be open, be licensed, or meet your expectations. Additional platform disclosures appear in our Platform Disclosures.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREET EATS AND BUHRN TECHNOLOGIES LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OR GOODWILL; VENDOR OR USER CONDUCT; FOOD QUALITY, SAFETY, OR ALLERGENS; TRAVEL OR PARKING DECISIONS; EVENT OUTCOMES; FORCE MAJEURE OR OUTAGES BEYOND OUR REASONABLE CONTROL; OR ANY TRANSACTION BETWEEN USERS, VENDORS, OR PARTNERS. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO STREET EATS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID STREET EATS IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. This limit does not cap our right to recover from you for a breach of Sections 4 or 5. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; rights that cannot legally be limited remain unaffected.

15. Indemnification

You agree to defend, indemnify, and hold harmless Buhrn Technologies LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your violation of these Terms (including Sections 4 and 5), or your violation of any law or the rights of a third party. If you use Street Eats for a business, including as a vendor, partner, or event coordinator, this duty also covers your operations and your dealings with customers or attendees.

16. Dispute resolution and governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and give us 30 days to work toward an informal resolution. That wait does not apply to a claim for unauthorized scraping, harvesting, copying, reverse engineering, circumvention, or other misuse of Street Eats intellectual property or data. For those claims we may seek immediate injunctive or other equitable relief. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Harris County, Texas, and both parties consent to that venue, except that either party may use small-claims court where eligible. To the extent permitted by law, claims must be brought individually and not as part of a class or representative action. If the law where you live gives you mandatory consumer rights or venue protections, these Terms do not take those rights away.

17. Termination

You may stop using Street Eats at any time. We may suspend or terminate access immediately if you violate these Terms, create legal or safety risk, or if we discontinue the service. A termination for breach of Sections 4 or 5 does not end our right to demand deletion, seek injunctive relief, or recover damages. Sections that by their nature should survive, including ownership, the limited license, the no-scraping and no-replication rules, content licenses, feedback rights, disclaimers, limitation of liability, indemnification, and dispute terms, survive termination.

18. General terms

These Terms, the Privacy Policy, and the Platform Disclosures are the entire agreement between you and us about Street Eats. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only and do not affect interpretation.

19. Changes and contact

We may update these Terms and will post the revised effective date. Continued use after an update means you accept the revised Terms, except where applicable law requires additional notice or consent.
